hereinafter referred to as "personalisierter-song.de", and the client, hereinafter referred to as "customer", about the purchase of products in this shop. The contract is legally binding when the customer submits the order and the order is accepted by Geschenkideer-song.de by sending a confirmation email.

§ 2 Tasks of Geschenkideer-song.de Geschenkideer-song.de produces songs that are tailored to the specific wishes of the customer. The songs are made available to the customer as a download or sent on CD including a cover chosen by the customer and - depending on the type of packaging - inlays and labels.

§ 3 Prices & payment conditions All prices in the shop of Geschenkideer-song.de are final prices in euros including the applicable VAT plus any shipping costs. The prices at the time of the order apply. Payment of the price is due when the contract is concluded and must be made within three banking days after the contract is concluded. The customer pays in advance, by direct bank transfer or PayPal. If the customer defaults on payment, Geschenkideer-song.de reserves the right to charge the customer reminder fees and to stop supplying the customer. The customer can only assert a right of retention if it is based on the same contractual relationship. A reminder from Geschenkideer-song.de is unnecessary.

§ 4 Retention of title, right of use All delivered items and goods remain the property of personalizedr-song.de until full payment has been made. A right to use the songs only arises upon full payment. Upon payment and delivery, the customer receives the non-exclusive right to use the song. Use for a fee is not permitted.

§ 5 Delivery / Delivery times Delivery is made by Deutsche Post AG. Deliveries within Germany are made within the delivery times shown here. You can find the shipping costs here. Shipping costs may be reduced or free during promotional periods.

§ 6 Warranty / Right of Return The warranty is provided in accordance with the statutory provisions, whereby we are entitled to deliver or repair the goods at our discretion in the event of a defect. If the repair ultimately fails or the subsequently delivered goods are also defective, you can request the return of the goods against reimbursement of the agreed price, cancellation of the outstanding invoice or reduction of the purchase price. Any further guarantee commitments can be found in the product descriptions.

According to Section 312g Paragraph 2 Sentence 1 Number 1 of the German Civil Code, the customer is not entitled to a right of withdrawal, since the products sold by personalizedr-song.de are exclusively goods manufactured according to customer specifications.

§ 7 Liability Personalizedr-song.de assumes no liability for faulty productions that occur due to incorrect information provided by the customer. Personalizedr-song.de cannot and will not accept any responsibility or liability for orders placed by Internet users with incorrect data or the data of other people.

§ 8 Complaints The packaging of the goods must be checked for any damage upon receipt. If damage to the packaging is evident, the customer must have this recorded by the deliverer or supplier.

§ 9 Data protection / data security Customer data is stored and processed by Geschenkideer-song.de in compliance with the relevant provisions of the Federal Data Protection Act, the Telecommunications Act and the Teleservices Data Protection Act. Geschenkideer-song.de does not pass on the customer's personal data, including the home address and email address, to third parties. Excepted from this are the service partners of Geschenkideer-song.de, who require the transmission of data to process orders. In these cases, however, the scope of the transmitted data is limited to the minimum required. The customer has a right to information as well as a right to correction, blocking and deletion of his stored data. This can be done by contacting us via info@ personalizedr-song.de or by post.

§ 10 Choice of law / place of jurisdiction German law is agreed. The UN Convention on Contracts for the International Sale of Goods does not apply. In dealings with end consumers, the law of the court of the end consumer's place of residence is also responsible for contractual disputes. § 11 Layout and design Minor changes in the layout, design or color of the products shown in the shop are possible for production reasons. However, this does not result in any loss of quality. § 12 Abuse / False information In the event of misuse of this online shop or knowingly providing false information (ordering in someone else's name), the perpetrator will be investigated and a criminal complaint filed.

§ 13 Partial invalidity Should one of the provisions of these General Terms and Conditions be or become invalid or unenforceable, the remaining provisions shall remain unaffected.

§ 14 Miscellaneous personalizedr-song.de reserves the right to shorten or edit the lyrics provided by the customer for the package "Song with your story" if this is necessary for the production of the respective song. Changes are particularly necessary if a text cannot be sung. The changes are kept as minimal as possible so that the meaning and the original words correspond as closely as possible to the specified text.
